1. Scope
These General Terms and Conditions (GTC) apply to all contracts, deliveries and other services of Boss.Bss LLC (hereinafter “Provider”) with its customers (hereinafter “Customer”) in connection with the sale of precious metals (gold, silver, platinum, palladium) as well as in the context of investment recommendations.
Deviating conditions of the customer are not recognized unless Boss.Bss LLC expressly agrees to their validity in writing.
The GTC apply internationally, regardless of the domicile or registered office of the customer.
2. Conclusion of Contract
Offers of the Provider are non-binding and subject to change.
The contract is only concluded through the written order confirmation of the Provider or by delivery of the goods.
All offers are subject to the availability of the goods.
3. Prices and Terms of Payment
All prices are quoted in EUR and are exclusive of applicable taxes and shipping costs.
Precious metal prices are subject to daily fluctuations. The price at the time of the binding order is decisive.
The Provider reserves the right to make subsequent calculations in the event of price changes or market volatility.
Payments must be made within 5 working days after the conclusion of the contract without deduction.
4. Delivery and Shipping
Shipping is carried out exclusively insured and by specialized value logisticians.
Delivery times are agreed individually. Delivery delays due to force majeure, market disruptions or official measures do not give rise to claims for damages.
Delivery is made to the curbside.
5. Retention of Title
The goods remain the property of Boss.Bss LLC until full payment has been made.
The customer undertakes to store the goods carefully until full payment has been made.
6. Risk Notice and Disclaimer
Precious metal purchases and investment recommendations involve economic risks.
Boss.Bss LLC does not guarantee value increases or future market developments.
Investment recommendations do not constitute individual financial advice.
7. Returns and Withdrawal
A right of withdrawal only exists if this is required by law. Precious metals are excluded from return and withdrawal due to their price volatility.
Complaints must be reported in writing within 48 hours of receipt of the goods.
8. Identity Verification (KYC/AML)
The customer is obliged to carry out an identity check (KYC) before the conclusion of the contract.
In the case of expired identification documents, the provider reserves the right to request renewed checks and to withhold payments until successful verification.
Boss.Bss LLC is obliged to report suspicious transactions in accordance with the applicable anti-money laundering regulations (AML).
9. Data Protection
The Provider processes personal data exclusively within the framework of the GDPR and other relevant data protection laws.
Customer data will not be passed on to third parties unless this is necessary for the fulfillment of the contract.
10. Investment Recommendations
All recommendations made by the Provider are non-binding and do not constitute financial analysis.
The customer decides independently on each investment.
Boss.Bss LLC assumes no liability for losses resulting from the implementation of the recommendations.
11. Dispute Resolution and Place of Jurisdiction
The law of the Republic of Kosovo shall apply exclusively.
The place of jurisdiction is Pristina, Kosovo.
12. Severability Clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
